Terms of Use

1. Operator

OutSence is operated by Andrei Protasevich, sole proprietor, located in Belgrade, Serbia (“we,” “us,” or “our”).

2. Eligibility

OutSence is intended only for individuals who are 21 years of age or older. By using the service, you confirm that you are at least 21 years old.

3. The Service

OutSence allows users to upload their own portrait photograph, select one or more available styles, and receive AI-generated images based on the selected styles.

We may modify, update, suspend, discontinue, restrict, or limit any part of the service at any time, including available styles, features, outputs, service flow, and pricing before checkout is completed.

4. Accounts and Guest Access

You may use the service either through an account or, where available, as a guest.

If you use the service as a guest:

• generated images are available only during the current results flow;
• if you start a new flow, close the flow, close the page, refresh the page, or otherwise leave the results step, you may lose access to previously generated images;
• generated images are deleted from the service after 12 hours.

If you use the service through an account:

your generated images are stored and made available in My Creations until you delete them or delete your account.

If you use the service as a guest, you are solely responsible for saving your generated images before they expire or become unavailable.

You are responsible for your use of the service and for any activity carried out through your account or session.

5. User Content

You may upload content to the service, including your portrait photograph (“User Content”).

By uploading User Content, you represent and warrant that:

• the uploaded photograph is your own portrait photograph and depicts you;
• you own the content or have all necessary rights and permissions to use and submit it;
• your User Content and your use of the service do not violate any law or infringe any third-party rights.

You must not upload or submit:

• nude or sexually explicit content;
• illegal, hateful, violent, abusive, or otherwise prohibited content;
• content that infringes the rights of others;
• content intended to deceive, impersonate, or harm others.

We may refuse to process, remove, delete, disable, or reject User Content, cancel an order, or block an account if we reasonably believe these Terms or applicable law have been violated. We are not obligated to store, maintain, or provide access to content that we refuse to process or remove under these Terms.

6. License to Process User Content

You retain ownership of your User Content.

You grant us a limited, non-exclusive license to host, store, cache, reproduce, transmit, and process your User Content only as necessary to operate, provide, secure, troubleshoot, prevent abuse, and maintain the service.

We may transfer your User Content to third-party service providers solely for the purpose of providing the service.

We do not use your uploaded photographs or generated images to improve the service.

7. Generated Images

Generated images created through the service belong to you.

Subject to applicable law and third-party rights, you may use your generated images for personal or commercial purposes at your own discretion.

You are solely responsible for how you use generated images and for ensuring that such use complies with applicable law and does not infringe the rights of others.

We do not guarantee that generated images will be unique, and they may be similar to other outputs generated for other users.

8. Payments, Orders, and Refunds

The service is provided on a one-time payment basis depending on the number of styles selected.

Payments are processed by a third-party payment provider. We do not store your full payment card details.

Prices, available styles, and available service options may change at any time before checkout is completed.

We may reject, refuse, or cancel an order before generation begins where reasonably necessary, including in cases of suspected fraud, abuse, automation, legal or compliance concerns, technical issues, payment problems, or violations of these Terms.

Once processing or generation has begun, no refund is available. An order is deemed fulfilled once the generated images are made available in the results step, regardless of whether you download or save them, and regardless of any later loss of access caused by guest mode, restarting the flow, closing the page, or similar user actions.

No refund is available for:

• failure to download or save generated images;
• loss of access caused by guest-mode limitations;
• dissatisfaction with artistic style, likeness, resemblance, realism, or other characteristics of AI-generated results.

If payment fails, is reversed, or is disputed, we may suspend access to the relevant service or results.

9. No Guarantee of Result

We aim to preserve the appearance of the person shown in the uploaded photograph, but results are generated by AI and are inherently unpredictable.

We do not guarantee that generated images will:

• match your expectations;
• preserve any particular facial features, style, likeness, or level of realism;
• be accurate, error-free, unique, uninterruptedly available, or suitable for any specific purpose;
• be compatible with every device, browser, or platform.

10. Acceptable Use

You must not:

• use the service in violation of any law or regulation;
• upload content you do not have the right to use;
• attempt to reverse engineer, interfere with, or disrupt the service;
• probe, scan, test, or exploit vulnerabilities in the service or related systems;
• bypass technical limitations, security measures, or usage restrictions;
• use the service for fraud, impersonation, abuse, or infringement of third-party rights;
• create misleading identity-based content or otherwise use the service in a deceptive or harmful manner;
• use generated images for unlawful impersonation, fraud, deception, or infringement of third-party rights;
• use automated means to scrape, copy, or extract data from the service without authorization;
• access or use the service through AI agents, bots, scripts, or other automated systems without our prior written permission;
• resell, sublicense, commercially exploit, or provide third parties with access to the service itself without our prior written permission.

11. Suspension and Blocking

We may suspend or block access to the service, refuse processing, cancel an order before generation, or terminate an account, with or without prior notice, temporarily or permanently, if we reasonably believe that:

• you violated these Terms;
• you submitted prohibited content;
• your use of the service creates legal, security, technical, payment, or abuse risks.

We may also limit, deny, or cancel access to the service based on suspected abuse, misuse, fraud, automation, or other prohibited activity, without any obligation to provide a detailed explanation, except where required by applicable law.

If an order has already been processed, no refund is required solely because access is later suspended or blocked due to a violation of these Terms.

12. Privacy

Your use of the service is also governed by our Privacy Policy, which explains how we collect, use, store, and delete personal data.

13. Disclaimer

The service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of availability, merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability.

We are not responsible for delays, failures, interruptions, or unavailability caused by third-party providers, infrastructure failures, internet disruptions, force majeure events, or other circumstances beyond our reasonable control.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or opportunity arising out of or related to your use of the service.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to the service will not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

15. Changes to These Terms

We may update these Terms from time to time. Any updated version will be posted on the website with a revised Effective Date.

By continuing to use the service after the updated Terms take effect, you agree to the revised Terms.
